The following license is a legal binding agreement between you (the Client) and Wackypixel Company (Wackypixel). By purchasing and downloading any stock icons the Client, agrees to all terms and conditions set by this license related to use and distribution of the icons.
For the purposes of this license, the term "icon" and "icons" means any symbol or graphic representation included in the "Stock Icons" section of this web site intended by Wackypixel to be used in computer-related activities involving any degree of commercial activity, including assistance in the operation of a terminal or personal computer or any other form of visual application or material. The term involves only those icons supplied directly by Wackypixel Co. when Wackypixel has actual knowledge and interest in the transaction of the symbols or graphic representations. Any material obtained by trickery, fraud or false pretenses shall be deemed not unauthorized and in violation of the terms of this license.
The Client agrees with all of the following:
- The icons are not to be altered, transformed, modified, concealed or disguised in any way by any third party without express written authorization by Wackypixel.
- The icons remain intellectual property of Wackypixel. The Client acquires the non-exclusive right possess and use the icons subject to the terms and conditions of this license. This right may be revoked upon the finding by Wackypixel that the Client is not in compliance with the terms and conditions of the license related to the authorized use of the material.
- The icons cannot be duplicated, copied, distributed, transferred, transported or altered, in whole or in part, in any way in or affecting intrastate, interstate or foreign commerce and as any separate product, including but not limited to the use of interactive computer services and other means of electronic distribution, without written authorization from Wackypixel.
- The icons may be used in transactions involving activities for commercial gain. The icons may be used to endorse, advertise or promote commercial but such use shall never be created or devised to imply any endorsement or affiliation between Wackypixel and the Client.
- There shall be no royalties or fees owed by the Client to Wackypixel resulting from the authorized use of the icons other than those required to purchase the license and any others discussed and approved by both parties. Unauthorized use of the icons may result in the Client's liability for restitution and other penalties as prescribed by this license and any other applicable law.
- The icons cannot be used, directly or indirectly, in whole or in part, as part of or in association with, any activity involving obscenity, pornography or any other illegal activity as defined by the law of the United States of America. Wackypixel assumes no liability for any violation resulting from the unauthorized use of the icons or any other material included in this web site.
- Wackypixel shall not be liable for any damages, whether direct, indirect, consequential or incidental, arising from the use of, or the inability to use, the icons or any individual image or material obtained in any way from Wackypixel.
- The terms and conditions of this license apply to any icon, graphic or material downloaded from this web site in any way, by any means, unless otherwise stated by Wackypixel.
Wackypixel reserves the right to alter, modify or terminate this license and the terms and conditions involved in the authorized use of the icons without warning or notification to any Client or third party. This license shall not be interpreted to restrict any law enforcement authority having jurisdiction to investigate and prosecute the Client's illegal use of the icons and material contained in the web site. Wackypixel shall cooperate with any law enforcement agency in the investigation and prosecution of any fraudulent activity involving the unauthorized use of the icons.
